FBI Seizes Swalwell's Devices in Sexual Misconduct Probe

The FBI executed search warrants over the weekend, seizing electronic devices from former Rep. Eric Swalwell (D-Calif.) as part of an ongoing criminal investigation into allegations of sexual misconduct. According to multiple reports, federal agents seized Swalwell's cellphone at San Francisco International Airport on Saturday and searched his Washington, D.C., home the following day.

Swalwell resigned from Congress in April after facing multiple allegations of sexual assault and misconduct that derailed his campaign for California governor. The bipartisan House Ethics Committee launched an investigation into these allegations but closed it upon his resignation, as the committee only has jurisdiction over current members and staff. The Department of Justice opened its own investigation following Swalwell's departure from Congress.

The sexual misconduct allegations against Swalwell include claims of rape and unsolicited explicit messages or photos from at least four women. According to reports, one former staffer alleged that Swalwell sexually assaulted her twice when she was too intoxicated to consent. Another woman claimed he drugged and raped her in 2018.

In addition to the sexual misconduct probe, the White House released declassified documents on Monday regarding an FBI investigation into Swalwell's past relationship with Christine Fang, a suspected Chinese intelligence operative. The 97-page document details the FBI's investigation into Swalwell and his 2015 relationship with Fang but notes that no charges were filed against him.

Swalwell has denied all allegations of sexual assault and misconduct. His attorney has stated that they are cooperating with all law enforcement agencies investigating the former congressman. The office of Manhattan District Attorney Alvin Bragg confirmed in April that it was investigating Swalwell after a former staffer told CNN and the Chronicle that Swalwell raped her at a hotel while he was in New York City for a charity gala in 2024.

The latest FBI raid comes as election authorities continue to count ballots in a closely contested special election for Swalwell’s open seat in Congress. As of Thursday, progressive Aisha Wahab led by about 300 votes over fellow Democrat Melissa Hernandez, who saw a surge in late spending by the American Israeli Public Affairs Committee (AIPAC).
